January 23rd, 1939.
Dear Mr. Cunningham,
I am sending you herewith a copy of particulars of the offences in the case of Kenji Kitabatake and nine others, who received judgment at the Osaka District court on November 17th, 1938, for breach of the regulations for the control of anaesthetics, with regard to which you requested information on the occasion of your visit on January 11th, 1939. In connexion with this I may add that judgment in the case of the defendants. Kuichi Motomura, Shigeru Imatomi, Mutsumi Yamada and Teizo Kitayama has become definitive, but that the defendants Toshio Shibata, Mantaro Asada, Shunzo Kitagawa, Shokichi Kuyusu, Shinichi Masuda, and Kenji Kitabatake are appealing to a higher court.
(Seal of Gaimusho)
Yours sincerely,
(sgd) Takanobu Mitani,
Director of the Treaty Bureau of the
Ministry of Foreign Affairs.
W.B. Cunningham, Esquire,
